This policy explains what happens to your data when you use the Mellovox app ("the app").

We are not required to appoint a data protection officer.
The app stores your recordings (the untouched original audio), edits, transcripts, titles, notes, tags, markers, Voice Profiles, projects, folders and app settings in the app's private storage on your device. This data is protected by the iOS sandbox and iOS Data Protection. We have no access to it. Storing it on your device is strictly necessary to provide the functions you use (§ 25 (2) no. 2 TDDDG).
The data stays until you delete it or delete the app. Recordings you delete stay in Recently Deleted for 30 days unless you delete them permanently earlier.
The app uses the microphone only while you record, after you tap Record. iOS asks for your permission first and shows the recording indicator while the microphone is active.
Transcripts are created on your device with Apple's speech recognition. The first time you transcribe in a language, iOS may download a speech model from Apple; your audio is not sent for this. On devices with Apple Intelligence, title, summary, keyword and chapter suggestions are generated on your device by Apple's on-device model from your transcript. Nothing is sent to us or to any third-party AI service.
Background noise removal uses Apple's voice isolation model on your device. "Read by Another Voice" has your transcript read by the text-to-speech voices installed on your device; the result is saved as a new recording on your device. Your audio and text are not sent anywhere for either feature.
If you turn on iCloud sync, your recordings, transcripts, edits, Voice Profiles, projects, folders and your default-profile setting are stored in the private CloudKit database of your iCloud account. Before upload, this content is encrypted on your device with a key stored in your iCloud Keychain, so neither we nor Apple can read it. Technical metadata such as record identifiers, record types, dates and sizes is visible to Apple's CloudKit service. Sync is off by default. The synced data stays until you delete it in the app (Settings › iCloud Sync) or in your iCloud settings.
Mellovox is free to download. Mellovox Pro is an optional one-time in-app purchase sold through the App Store. Apple processes the payment; we receive no payment details and no personal data. The app checks on your device, using Apple's StoreKit, whether Mellovox Pro has been purchased; this information stays on your device and with Apple. Apple provides us only with aggregated sales reports.
The app may occasionally ask whether you would like to rate it, using Apple's standard rating prompt. To decide when to ask, it keeps a small counter of successful exports on your device; the counter is never transmitted. Whether and how you respond is handled by Apple; the app does not learn your answer. You can turn off rating requests in iOS Settings › App Store.
When you share or export a file (audio, transcript, captions, Voice Profile, data export), it goes to the destination you choose, such as another app, AirDrop or Files. The destination's own privacy terms apply there.
The app contains no crash reporting or analytics of its own. If you have agreed in iOS settings to share analytics with app developers, Apple may provide us with crash reports and aggregated usage statistics that do not identify you to us. We use them only to find and fix errors (Art. 6 (1) (f) GDPR; our legitimate interest is a stable app). We receive this information from Apple, not from you directly. It contains no recording or transcript content.
If you email us, we process your email address and your message to answer you (Art. 6 (1) (b) GDPR for questions about a purchase, otherwise Art. 6 (1) (f) GDPR; our legitimate interest is answering your request). We delete support emails once your request has been dealt with, at the latest after two years, unless statutory retention periods apply.
The App Store, in-app purchases, iCloud and CloudKit, speech model downloads and diagnostics are services of Apple. Apple processes the data involved as an independent controller under its own terms and privacy policy (https://www.apple.com/legal/privacy/). For users in the EU, Apple's contracting party is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland. Apple may process data in the USA and other countries outside the EU and uses appropriate safeguards for such transfers, such as the EU-U.S. Data Privacy Framework and EU standard contractual clauses (see Apple's privacy policy). Your iCloud content from Mellovox is encrypted on your device before upload.
You have the right of access, rectification, erasure, restriction of processing and data portability (Art. 15–20 GDPR), and the right to object to processing (Art. 21 GDPR). Where processing is based on Art. 6 (1) (f) GDPR, you can object at any time on grounds relating to your particular situation.
You also have the right to lodge a complaint with a supervisory authority, for example the authority responsible for us: Die Landesbeauftragte für den Datenschutz Niedersachsen, Prinzenstraße 5, 30159 Hannover, Germany (https://www.lfd.niedersachsen.de), or the authority where you live.
Because we do not hold your app content, the quickest way to exercise these rights is usually in the app: you can export all your data (Settings › Storage & Your Data › Export All My Data), delete individual recordings, empty Recently Deleted, delete all data on the device, and delete the synced data from iCloud (Settings › iCloud Sync). We will still answer every request you send us.
If you record other people, you are responsible for obtaining any consent required by the law that applies to you.
Mellovox does not collect personal data from any user, including children.
We will update this policy if the app's data handling changes and will note the date above.
